Thank you for visiting Getting Paid to Draw with Mike Lowery! This website features Mike’s annual class in creating an illustration portfolio from scratch, as well as Mike’s other illustration workshops and guides, blogs, and more.
These terms and conditions (“Terms”) govern your access to and use of all Getting Paid to Draw/ Lowery Studio LLC-related websites, webpages, and applications, including but not limited to, all products, services, content, software, tools, features, and technology made available to you (collectively referred to as “Site”).Â
These terms include a mandatory arbitration provision and a class-action waiver. By agreeing to arbitration and a class action waiver in the event of a dispute, you are waiving your right to relief in a court of law and to a jury trial on your claims, and are only permitted to pursue claims and relief on an individual basis. Please read these terms carefully and do not use any of the Getting Paid to Draw/ Lowery Studio LLC sites or services if you do not agree with all the terms and conditions of use.
Acceptance of Terms
Your access and use of our Site is your express consent and acceptance of these terms. By using our Sites, you agree to be bound by and to abide by these Terms and the Privacy Policy. Any violation of these Terms may result in termination of your access and use of any Getting Paid to Draw/ Lowery Studio LLC Sites.Â
Changes to Terms
We may revise and update these Terms from time to time in our sole discretion. When changes are made, they will appear in all places where our Terms are displayed, with a revision date at the bottom indicating when the last change was made.Â
Amended Terms will be effective immediately; please review them regularly and become familiar with them.Â
Eligible Users
Mike Lowery’s materials are offered to users who are 18 years of age or older.
Free Trial and Coupons
On the occasion that you are a user who subscribes to any course program with a free trial period or coupon, you will need to submit payment information upon signing up. Your free trial begins immediately after you submit your payment information, and you will not be billed until the trial period ends.Â
If you do not cancel during your free trial, you consent to a monthly contract and agree to be billed the monthly membership fee until you cancel or upgrade to an annual term. Please note that if you've previously had a trial or you're a current/returning client, trials do not apply, and you will be billed immediately at the current monthly rate.
CancellationÂ
Students enrolled in Getting Paid to Draw may cancel for any reason during the first two weeks of the course. If you wish to cancel during that window, please email [email protected].
Refunds
Refunds are available only during the first two weeks of the Getting Paid to Draw course.Â
Your Account
When providing information to Getting Paid to Draw/ Lowery Studio LLC, you agree to provide only honest, accurate, current, and complete information about yourself. You further agree to update any information as it changes and acknowledge that if any information you provide is untrue, inaccurate, out of date, or incomplete, we reserve the right to terminate your access to and use of our Site. Our use and disclosure of the information you provide is governed by our Privacy Policy.
Access to the Kajabi Platform and/or ApplicationsÂ
To sign up for Getting Paid to Draw or other available workshops, you will create a login and password to access Kajabi, our class platform, and/or the Kajabi applications, including the Community. You will be responsible for the confidentiality and use of your username and password, and agree not to transfer, share, or resell your use of or access to Kajabi to any third party.Â
YOU ARE ENTIRELY RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY OF YOUR USERNAME AND PASSWORD AND FOR ANY AND ALL ACTIVITY (INCLUDING PURCHASES, AS APPLICABLE) THAT IS CONDUCTED THROUGH YOUR ACCOUNT. If you have any trouble accessing your Kajabi account, please email [email protected].
Your Use of the Site
While using our Site, you agree that your use will be for lawful purposes and in accordance with these Terms. You agree not to use this Site or any affiliated Site to:Â
- Violate any federal, state, local, or international law or regulation;
- Defame, abuse, stalk, threaten, exploit, or otherwise violate the rights of others, including, without limitation, others' privacy rights or rights of publicity;
- Impersonate any person or entity, falsely state or otherwise misrepresent your affiliation with any person or entity, or use any fraudulent, misleading, or inaccurate email address or contact information;Â
- Engage in any form or type of hacking;Â
- Express or imply that any statements you make are endorsed by Lowery Studio LLC;Â
- Advertise or solicit business for any other company in the illustration or art business, including other coaching businesses, MLMs, or any other commercial communication, whether solicited or not;
- Engage in any type or form of spamming;Â
- Transmit viruses of any kind;Â
- Modify, adapt, sublicense, translate, sell, reverse engineer, decompile, or disassemble any portion of the Site;Â
- Remove any copyright, trademark, or other proprietary rights notices contained in or displayed on any portion of the Site or the materials found within;Â
- “Frame” or “mirror” any portion of the Site, or link to any page or material on the Site other than the URL provided by us to you;
- Use of anything to reproduce or circumvent our Site; orÂ
- Harvest or collect information about users of our Site.
Intellectual Property RightsÂ
Lowery Studio LLC (and our licensors and guests, as applicable) is the sole owner of Getting Paid to Draw content in its entirety. These Terms permit you to use what Lowery Studio LLC makes available to you (such as video, print, or web-based content, and Student Art Assets) for your personal, non-commercial use only. You must not reproduce, modify, create derivative works of, publicly perform, or republish Lowery Studio LLC content and materials as your own for profit, or in a way that would cause confusion as to the true source of the material belonging to Lowery Studio LLC. We reserve all rights not specifically granted under these Terms. Â
User Submissions
Getting Paid to Draw/ Lowery Studio LLC permits users to share their story by submitting their testimonial, with or without art images. By submitting these testimonials and photos, you are authorizing Lowery Studio LLC to utilize all of the submitted information for purposes of marketing and for public viewing on any of our Sites. You understand you are responsible for anything you submit or contribute, and you have full responsibility for that content, including its legality, reliability, accuracy, and appropriateness.Â
You also understand that even though the testimonials we share are from real customers who have achieved their own satisfying results, they are not a reflection of what you can expect for your own results. Numerous factors contribute to someone's success in the creative field, and everyone's journey will be different.Â
Termination
You may stop using Getting Paid to Draw Sites at any time. Termination of your account does not relieve you of any obligation to pay any outstanding charges or fees. Lowery Studio LLC has the right to terminate your access to all or any part of our Site or program for any legal reason, but we would prefer not to do that. These terms will survive your termination, whether done on your own or by Lowery Studio LLC.Â
Idea Submissions
Many of our users are interested in submitting ideas and suggestions to help provide the very best to our customers. We appreciate your interest in improving the Site and what we offer, but please note that we typically develop programs and content internally. Any ideas or suggestions you submit are submitted voluntarily, with no intellectual property rights to those ideas. This is because Mike Lowery is constantly working on new projects, and your ideas could overlap with something we are already working on.
If you choose to submit an idea or suggestion that Mike Lowery incorporates at some time, whether in part or in full, you agree that it will solely be owned by Mike Lowery, and you have no rights to the idea or content that is used.Â
International Users
Our Sites are controlled and operated within the United States of America. You may not use or export Getting Paid to Draw/ Lowery Studio LLC services or content in violation of U.S. export laws and regulations. If you are accessing our Site from a location outside the United States, you are responsible for complying with all applicable local laws, rules, regulations, and ordinances.Â
Assumption of Risk
While we will always strive to provide you with the best, the content is provided “as is” without any warranties that the information will be uninterrupted, complete, secure, or error-free.
You understand that you are assuming the risk of using our site and its content and assume all responsibility for your reliance on it. You hereby acknowledge and willingly accept and hold Lowery Studio LLC harmless of any risks associated with your creative and professional journey and agree to unconditionally release Lowery Studio LLC from all claims, suits, damages, losses, causes of action, costs, expenses, or liability arising from your access, use, and/or involvement with Mike Lowery.
Limitation of Liability
In no event will Lowery Studio LLC., its affiliates, licensors, employees, independent contractors, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use our sites, apps, website link, content on our site or any content linked to our site.
IndemnificationÂ
Should Lowery Studio LLC become a party to any legal matter arising out of or relating to your use of our Sites, or relating to any violation of these Terms, including but not limited to your user submissions, any use of our content, services or products other than expressly authorized in these Terms, you agree to indemnify (pay back) and hold harmless (not blame) Lowery Studio LLC and be solely responsible and liable for any costs Lowery Studio LLC incurs.Â
Governing Law
These terms are governed by and in accordance with the laws of the State of Georgia, in the United States of America. By using our Sites, you agree to this jurisdiction for any legal proceeding, and waive any right to object to it.Â
Binding Arbitration
Any dispute or claim that cannot first be resolved between you and Lowery Studio LLC will be settled by binding arbitration in Georgia, under the Commercial Arbitration Rules of the American Arbitration Association (“AAA”). The arbitration will be conducted by one arbitrator appointed in accordance with the AAA rules. The arbitrator will apply the laws of the state of Georgia, and the arbitration will be in English. If necessary, you may pay any additional costs to have your own interpreter and/or to have the documents of the arbitration translated into your preferred language. The arbitration will be confidential and will not be open to the public. The arbitrator will render the decision, and it will be final. The prevailing party (as determined by the arbitrator) will be entitled to reimbursement from the other party for such costs and expenses of arbitration (including reasonable attorney fees). Please note that with arbitration, you waive your right to a jury trial. Binding arbitration is the only method to settle your dispute.
Waiver of Class ActionsÂ
You understand and agree that if you have a dispute with Lowery Studio LLC, your only remedy is in an individual capacity through arbitration. You waive your right to lead or participate in a lawsuit involving others, such as a class action.
Severability
If any provision in these Terms is considered invalid or unenforceable, that provision will be removed, and the remainder of these Terms will continue to be valid and enforceable.Â
Entire Agreement
The posted terms constitute the entire agreement between you and Lowery Studio LLC for the use of our Sites. The only valid change or modification is in the form of amended Terms published by Lowery Studio LLC.Â
